The extension dispute
In State of Maharashtra & Anr. v. Momin Moiuddin Gulam Hasan @ Moin Mistri & Anr., 2026 INSC 1021, the Supreme Court allowed Maharashtra's appeal against a Bombay High Court decision granting default bail in a UAPA prosecution. The issue concerned a further fifteen-day extension for filing the charge sheet and a subsequent default-bail application.
The Court upheld the Special Judge's extension order and dismissed the identified default-bail application. It held that the High Court's reasoning, including its discussion of prosecution sanction, did not correctly address the extension request. The first respondent was directed to surrender within thirty days, with liberty to seek regular bail.
Keep special-law rules separate
This decision concerns the legality of a particular extension in the UAPA setting. It does not remove the right to default bail or decide guilt. The applicable special-law provision, extension order and timing of the application must be examined together.
The outcome should not be automatically transferred to ordinary BNSS remand deadlines. Default bail and regular bail address different legal questions, and the documents needed to assess an extension include the actual judicial orders and the procedural chronology.
